Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Mad Kiwi ("Mad Kiwi", "we", "us", "our") governing your use of our mobile games and related services (together, the "games"). By downloading, installing, or playing a game, you accept these Terms. If you do not accept them, do not use our games.

1. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using our games, you consent to that collection and use.

2. Age Requirement

Our games are intended for a general audience aged 13 and older. By using our games, you confirm that you are at least 13 years old, or that you are using the games under the supervision of a parent or legal guardian who accepts these Terms on your behalf.

3. License to Use

Subject to these Terms and the policies of the app store you downloaded from, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use our games for your personal, non-commercial entertainment. This license does not give you any ownership of the games or their content.

4. Virtual Items & Purchases

• Some games offer optional in-app purchases ("IAP") of virtual currency or items.
• Virtual items have no real-world monetary value, cannot be exchanged for cash, and cannot be sold or transferred outside the game.
• Virtual items remain our property at all times, even after purchase; you are granted a limited license to use them within the game.
• All purchases are billed and processed directly by Apple App Store or Google Play — not by us. Purchases are final and non-refundable, except where required by applicable law or the relevant app store's refund policy.

5. Prohibited Conduct

When using our games, you agree not to:

• Reverse-engineer, decompile, disassemble, or extract source code or assets from the games
• Use cheats, exploits, bots, automation tools, or unauthorized third-party software
• Interfere with or disrupt our servers, networks, or other players' experience
• Impersonate any person, or use the games for any unlawful, abusive, or fraudulent purpose
• Circumvent, disable, or otherwise interfere with security features of the games

Violation of this section may result in suspension or termination of your access to the games.

6. Intellectual Property

All content in our games — including but not limited to characters, artwork, code, music, sound effects, and the Mad Kiwi name and logo — is owned by Mad Kiwi or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

7. User Content

If a game allows you to submit feedback, reviews, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for the purpose of operating and improving our games. You confirm you have the right to submit any content you provide.

8. Advertising

Our games are supported by in-app advertising delivered through third-party ad networks described in our Privacy Policy. Some games may offer optional rewarded ads in exchange for in-game rewards.

9. Disclaimers

Our games are provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the games will be uninterrupted, error-free, or free of harmful components. Nothing in this section limits any statutory rights you may have that cannot be excluded under the law of your country of residence.

10. Limitation of Liability

To the maximum extent permitted by law, Mad Kiwi will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, our games.

11. Trademarks

"Mad Kiwi" and the names of our individual games are trademarks of Mad Kiwi. You may not use them without our prior written permission.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any mandatory rights you have under the law of your country of residence.

13. Changes & Termination

We may update these Terms, or modify, suspend, or discontinue any game, at any time. Material changes will be reflected by updating the "Effective date" above. We may suspend or terminate your access to a game for violation of these Terms. Continued use of our games after changes take effect constitutes acceptance of the revised Terms.
